Summary

After receiving two separate denunciations, the Office of Inspector General investigated the award of subcontracts to an ineligible person by Les Entreprises K.L. Mainville for the years 2020–2021 and 2021–2022. Louis-Victor Michon and the companies he headed were in fact excluded by City Council from any public contracts for a period of five years, from November 8, 2016, to November 7, 2021. They were excluded following publication of a public report by the Office of Inspector General on collusive agreements between Louis-Victor Michon and his company and a competitor.
The Office of Inspector General’s investigation revealed that K.L. Mainville and its president, Serge Mainville, allowed Louis-Victor Michon to work on municipal contracts in 2016, 2018 and 2021. Louis-Victor Michon was awarded subcontracts through Excavation Bromont inc. based on a fronting agreement with the company’s president, Daniel Girard. The actions by these companies and their presidents contravened Ville de Montréal’s by-law on contract management.
In view of the seriousness of the breaches that were determined and non-compliance with a contract requirement, the Inspector General is rescinding the two contracts awarded to K.L. Mainville following Call for Tenders 21-18750. The Inspector General also believes that Louis-Victor Michon, Serge Mainville and Les Entreprises K.L. Mainville should be declared ineligible for Ville de Montréal contracts for a period of five years. The term of this penalty should be four years for Excavation Bromont and three years for Daniel Girard.
